Legislation, Recognition and Enforcement

The Cayman Islands adopted modern arbitration statute based on the UNCITRAL Model Law on International Commercial Arbitration 1985 (as amended in 2006) and the English Arbitration Act 1996 when it enacted the Arbitration Law 2012. There is a strong history of enforcement proceedings in relation to foreign awards and the Cayman Islands is an attractive location due to the relative ease and speed of obtaining enforcement of a foreign award.

As a party to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the New York Convention), the Cayman Islands (as an overseas territory of the United Kingdom) has widespread applicability across most jurisdictions in the world, making it a simple process to enforce any arbitral award obtained in the Cayman Islands elsewhere (and vice versa). Additionally, the Enforcement Law gives effect to the provisions of the New York Convention, which allows for foreign arbitral awards to be enforced in the Cayman Islands.

Furthermore, the Arbitration Act goes above and beyond by stipulating that any arbitral award, regardless of where it was made, will be recognized as binding and enforced upon application to the Court, subject to the provisions of the Enforcement Law. This includes arbitral awards from foreign states, not just signatories to the New York Convention, which can be enforced with ease and efficiency in the Cayman Islands.
